Welcome to hubl, a multi-vendor marketplace connecting buyers with local businesses across the UAE and Middle East region. By accessing or using hubl, you agree to be bound by these Terms and Conditions. These terms apply to all users, including buyers and sellers.

1. ELECTRONIC COMMUNICATIONS

When you use hubl or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically, including by email, text, in-app notifications, or by posting messages on the platform. For contractual purposes, you agree that all agreements, notices, disclosures, and other communications that we provide you electronically satisfy any legal requirement that such communications be in writing, unless mandatory applicable laws specifically require a different form of communication. You also consent to receive sales invoices electronically, which will be made available in your account dashboard.

2. PLATFORM OVERVIEW

hubl is an online marketplace that enables sellers to list and sell products to buyers. hubl facilitates transactions but is not a party to the actual sale between buyers and sellers. All transactions occur directly between buyers and sellers, with hubl providing the platform infrastructure. hubl is neither the buyer nor the seller of products listed by third-party sellers. While hubl helps facilitate transactions carried out on the marketplace, the contract formed at the completion of a sale is solely between buyer and seller. hubl is not a party to this contract nor assumes any responsibility arising out of or in connection with it. Sellers are responsible for the sale of their products and for dealing with any buyer claims or issues arising from the transaction.

3. USER ELIGIBILITY

All users must provide accurate information during registration, be at least 18 years of age, and comply with UAE and Middle East regional laws. If you are under 18, you may only use hubl with the involvement of a parent or guardian. Sellers must additionally possess a valid business license throughout their use of the platform, provide valid government-issued ID for verification, and meet hubl's business eligibility requirements.

4. SELLER TERMS

4.1 Business Requirements

All sellers must maintain a valid business license throughout their use of the platform. Sellers must provide accurate business information, valid government-issued ID, and documentation upon request. Sellers must verify exclusive distribution agreements if applicable. All products must be handmade by the seller, manufactured by the seller, or sold under an exclusive third-party distribution agreement (subject to verification). Prohibited: Third-party resellers, major brand distributors without exclusive agreements, dropshipping operations, and bulk wholesale resellers. hubl focuses on business development for end users and prohibits sales by resellers who purchase products from hubl to resell to their direct customers. If hubl discovers that you resell products purchased from hubl, we reserve the right not to allow product purchases by your account and may permanently close your account. hubl will review each business individually and reserves the right to reject any business that does not align with hubl's mission, vision, and value proposition.

4.2 Product Approval

hubl reserves the right to approve or deny businesses and/or their products based on alignment with our platform values and standards. Prohibited items include: illegal items or substances, harmful or dangerous products, alcoholic beverages, nudity or sexual content, non-halal items, pork products, items not compliant with UAE or GCC regulations, counterfeit or intellectual property infringing products, dropshipped products, and any items hubl deems inappropriate or inconsistent with platform values.

4.3 Commission and Fees

hubl charges a 12% commission fee on all sales made through the platform, regardless of payment method (including cash on delivery). Commission is calculated on the total sale price (inclusive of tax). hubl covers all Stripe payment gateway processing fees. Sellers are responsible for shipping costs, chargeback fees (if applicable), and any other third-party service fees. Commission fees are automatically deducted from seller's available balance before withdrawal. All product prices listed must be inclusive of applicable taxes (e.g., UAE VAT 5%).

hubl reserves the right to introduce, modify, or remove fees at its discretion, including but not limited to: commission rates on sales, listing or product upload fees, monthly or annual subscription fees, advertising and promotional service fees, and premium features or tools. hubl will provide at least 60 days' advance notice of any fee changes via email, notification, or direct message. By continuing to use hubl's services after the notice period, you agree to the updated fee structure. If you do not agree to fee changes, you may deactivate your shop before the changes take effect by contacting hello@hubl.shop. Sellers who join during promotional periods (e.g., reduced commissions, free trials) acknowledge that promotional terms are temporary. hubl may modify or discontinue promotional pricing with appropriate notice as outlined above. Closing your shop does not waive your responsibility to pay fees for transactions completed before closure or for any outstanding balances owed to hubl.

4.4 Pricing Requirements

All listed prices must reflect the actual sale price and be inclusive of tax. Sellers must maintain consistent pricing across all sales channels (their own e-commerce platforms, physical stores, and hubl). Sellers may not artificially inflate prices on hubl to offset commission fees. Sellers may not use misleading discount tactics or fake "sale" prices. Despite our best efforts, a small number of items in our catalogue may be mis-priced. Sellers will be notified if pricing errors are detected. If a product's correct price is higher than listed, hubl may contact the seller before fulfillment. If a product's correct price is lower, the lower amount will be charged. Violation of pricing requirements may result in product listing removal, account suspension, account termination, or legal action if fraud is suspected.

4.5 Product Listings

Sellers must provide accurate, honest product descriptions, images, and pricing. Product images and descriptions must not infringe on any copyright, trademark, or intellectual property rights. Unless expressly indicated otherwise, sellers are the manufacturers or authorized distributors of the products sold. While we work to ensure that product information is correct, actual product packaging and materials may contain more and different information than displayed. We recommend that buyers do not rely solely on information presented on the platform and always read labels, warnings, and directions provided with the product before use. For healthcare products, buyers should carefully read information provided with the product or contact the manufacturer. Content on this site is not intended to substitute for advice given by medical practitioners or licensed healthcare professionals. Sellers may not engage in keyword stuffing or misleading SEO tactics, false or exaggerated product claims, review manipulation or fake reviews, or competitor sabotage or defamation. Sellers are responsible for maintaining adequate inventory. Out-of-stock items must be marked as unavailable or removed promptly.

4.6 Intellectual Property, Content & Data Protection

Sellers retain ownership of all product images, descriptions, and content they upload. By uploading content to hubl, sellers grant hubl a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, display, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute seller content for platform operations, marketing and promotional purposes, and social media and advertising campaigns. Sellers warrant that they have the right to use all content they upload and that such content does not infringe on third-party rights. hubl reserves the right to immediately terminate seller accounts found to be infringing on intellectual property rights. Sellers indemnify hubl against any claims arising from their content or intellectual property violations.

You may not use AI-generated content from hubl to, directly or indirectly, develop or improve large language or multimodal models, machine learning models, or related technology. You may not use any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) any substantial parts of hubl's content without our express written consent. You may not create and/or publish your own database that features substantial parts of hubl (e.g., our prices and product listings) without our express written consent.

4.7 Order Fulfillment

Sellers must fulfill orders promptly and as described. Sellers are responsible for packaging, shipping, and delivery of products. Sellers must communicate shipping timelines clearly to buyers before purchase. Sellers must provide tracking information when available and update order status promptly through the platform. We list availability information for products on the platform. Beyond what we say on product pages, we cannot be more specific about availability. As we process orders, we will inform buyers by email as soon as possible if any products turn out to be unavailable. Delivery estimates are just that—they are not guaranteed delivery times and should not be relied upon as such.

4.8 Seller Performance Standards

Sellers must respond to buyer inquiries within 48-72 hours. Failure to respond may result in warnings, suspension, or termination. Repeated violations of the following may result in account suspension or termination: non-response to buyer messages (3+ complaints within 30 days), consistent negative reviews or buyer complaints, failure to fulfill orders as described, shipping delays without communication, or violation of pricing, product listing, or conduct policies. Sellers who fail to respond to buyer messages for extended periods may have their accounts suspended or terminated. hubl reserves the right to suspend or terminate accounts showing patterns of poor communication or customer service.

4.9 Order Cancellations

Sellers may cancel orders only for legitimate reasons (out of stock, unable to fulfill, etc.). Excessive cancellations (more than 5% of orders in a 30-day period) may result in account review, suspension, or termination. Sellers must communicate cancellations to buyers immediately and process refunds within 7 business days. Buyers may request cancellations before shipment. Sellers must honor reasonable cancellation requests made before order fulfillment. Refund processing is the seller's responsibility.

4.10 Warranties

Warranty, refund, shipping, and return policies are determined by each seller individually and can be viewed in their storefront details. Sellers are responsible for honoring their stated warranty terms. hubl does not provide warranties on third-party seller products. Sellers are strongly recommended to carry appropriate product liability insurance.

5. PAYMENT PROCESSING & PAYOUTS

5.1 Payment Processing

All payments are processed through Stripe. hubl covers all Stripe payment processing fees. Sellers are responsible for their own business's legal compliance, tax obligations, and any disputes arising from sales. Buyers' payment information is processed securely through Stripe and is not stored on hubl servers.

5.2 Seller Payouts & Withdrawals

Sellers may request withdrawal of available balance through their dashboard. Payouts are processed 2-4 weeks after delivery confirmation. Minimum withdrawal amount: AED 50. Seller's available balance = Total sales revenue - 12% hubl commission - chargeback fees (if applicable) - any other owed amounts. Commission is owed on all sales, regardless of payment method (including cash on delivery). Sellers can only withdraw their net positive balance.

hubl reserves the right to delay or withhold payouts due to: compliance reviews, risk monitoring or fraud investigation, outstanding disputes or chargebacks, verification requirements from Stripe, regulators, or hubl, or negative account balance. Payouts may be held for up to 90 days to cover potential disputes, chargebacks, or refunds.

5.3 Chargebacks

Chargebacks occur when a buyer disputes a charge with their bank/credit card company and the bank reverses the payment. Sellers are fully responsible for all chargebacks and associated fees (typically AED 55-75 per chargeback). Chargeback amounts and fees will be automatically deducted from the seller's available balance. If a seller has insufficient balance, hubl may deduct from future sales, invoice the seller directly, or suspend payout privileges until the debt is settled.

5.4 Negative Balance Recovery

In the event of a negative Stripe or hubl balance (due to chargebacks, refunds, or fees), sellers agree that hubl may recover owed amounts from future payouts, invoice the seller directly for immediate payment, or suspend the seller's account until the balance is settled. Failure to settle a negative balance within 30 days may result in account termination and potential legal action.

5.5 Tax Responsibilities

Sellers are solely responsible for determining and fulfilling all applicable tax obligations. All product prices must be listed inclusive of applicable taxes (e.g., UAE VAT 5%). Sellers must register for VAT with the UAE Federal Tax Authority if their annual revenue meets the mandatory threshold (currently AED 375,000). UAE Corporate Tax applies to businesses with annual taxable income exceeding AED 375,000. Sellers below this threshold may not be required to pay corporate tax, but should consult with qualified tax professionals to confirm their obligations. Sellers must maintain accurate records of all transactions for tax reporting purposes. hubl does not provide tax advice; sellers should consult qualified tax professionals. Sellers must comply with all local, federal, and GCC tax regulations.

6. BUYER TERMS

6.1 Purchases

All purchases are subject to the individual seller's terms and policies. Buyers must provide accurate shipping and payment information. Payment processing is handled securely through Stripe. Buyers are responsible for reviewing product descriptions, seller policies, and shipping information before purchase. Your order is an offer to the seller to buy the product(s) in your order. When you place an order, you will receive an email confirming receipt of your order (Order Receipt Confirmation). This email is acknowledgment that the seller has received your order and does not confirm acceptance of your offer to buy the products ordered. The seller accepts your offer and concludes the contract of sale when they ship the product to you and send confirmation that they've shipped the product (Shipping Confirmation). If your order is shipped in more than one package, you may receive separate confirmations for each package.

6.2 Product Issues & Communication

Buyers should communicate directly with sellers regarding product inquiries, issues, or concerns through hubl's chat feature. Buyers must allow sellers 48-72 hours to respond to inquiries. For escalated or unresolved issues, buyers may contact hello@hubl.shop.

6.3 Address Accuracy

Buyers are responsible for providing accurate and complete shipping addresses. Address changes after purchase must be coordinated directly with the seller. hubl is not responsible for delivery failures due to incorrect buyer-provided addresses.

6.4 International Orders & Customs

When ordering products from hubl for delivery outside of the UAE, you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; hubl has no control over these charges. Customs policies vary widely from country to country, so you should contact your local customs office for further information. When ordering from hubl, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the products. Cross-border deliveries are subject to opening and inspection by customs authorities.

7. OFF-PLATFORM TRANSACTIONS

To ensure user safety and maintain platform protections, all transactions must be completed through hubl. Taking communications or transactions off-platform is strictly prohibited. This includes making offers to buy/sell outside hubl, directing users to external platforms, websites, or contact methods, completing hubl-initiated transactions elsewhere, or sharing personal contact information to circumvent platform fees. Sellers may not alter prices after sale to avoid transaction fees. Violation of this policy will result in immediate account termination.

8. PLATFORM LIABILITY

8.1 Product Responsibility

hubl shall not be held responsible for any defective, damaged, or poor-quality products. Sellers hold full responsibility to ensure all products sold are in good condition and meet described standards. Product-related issues should be managed between buyer and seller via hubl's chat section. If a product causes harm, injury, or damage, the seller is fully liable. Sellers are strongly recommended to carry appropriate product liability insurance. Sellers indemnify hubl against any claims, damages, or legal action arising from their products. hubl may cooperate with authorities but is not liable for seller negligence.

8.2 Transaction Disputes

Returns and refunds are solely the responsibility of the seller. hubl is not liable for seller failure to deliver products or services. hubl does not guarantee seller performance or product quality. hubl will facilitate communication between buyers and sellers but cannot force seller compliance. Buyers may consider payment processor dispute options (chargebacks) for unresolved issues.

8.3 Dispute Resolution & Mediation

Step 1: Buyer contacts seller directly through hubl's chat feature. Step 2: If unresolved within 7 days, buyer may escalate to hello@hubl.shop. Step 3: hubl will review the case and facilitate communication. Step 4: hubl's role is limited to mediation; we cannot force refunds or returns. Step 5: Buyers may pursue chargeback through their bank if the seller is unresponsive or non-compliant. If a seller is unresponsive, repeatedly violates policies, or engages in fraudulent behavior, hubl may suspend or terminate the seller's account, assist buyers in filing disputes with payment processors, or cooperate with authorities if illegal activity is suspected. hubl does not offer a buyer protection fund or guarantee at this time.

9. PROHIBITED CONDUCT

The following conduct is strictly prohibited and may result in immediate account suspension or termination. For all users: harassment, discrimination, or abusive language; fraudulent activity or misrepresentation; attempting to circumvent platform fees or policies; sharing personal contact information to take transactions off-platform; spamming or unsolicited marketing messages; impersonating another user or business; or violating any applicable laws or regulations. For sellers: review manipulation, fake reviews, or incentivized reviews; competitor sabotage or defamation; keyword stuffing or misleading SEO tactics; listing prohibited items; price manipulation or misleading discounts; dropshipping; reselling products without exclusive distribution agreements; copyright or intellectual property infringement; failing to fulfill orders as described; or consistently poor customer service or non-responsiveness. For buyers: filing false chargebacks or disputes; abusing return/refund policies; or harassing sellers.

10. ACCOUNT SECURITY & MANAGEMENT

10.1 Account Security

Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. Users must notify hubl immediately of any unauthorized account access at hello@hubl.shop. Users should take all necessary steps to ensure that passwords are kept confidential and secure. hubl reserves the right to suspend accounts showing suspicious or fraudulent activity. Users may not share, transfer, or sell their accounts to third parties.

10.2 Account Verification

Sellers must provide accurate business documentation (business license, government-issued ID) for verification. hubl may request additional verification at any time. Failure to provide requested verification within 14 days may result in account suspension.

11. ACCOUNT TERMINATION

11.1 Termination by hubl

hubl may terminate accounts for violation of these terms with 7 days written notice to the user's registered email. Immediate termination (without notice) may occur for fraud or illegal activity, safety concerns or threats, severe policy violations (off-platform transactions, intellectual property infringement, harassment), or repeated violations after warnings. Terminated sellers may appeal within 30 days by contacting hello@hubl.shop with supporting documentation.

11.2 Termination by User

Users may close their accounts at any time through account settings or by contacting hello@hubl.shop. Sellers must fulfill all pending orders before account closure. Sellers with outstanding balances (negative or positive) must settle accounts before closure.

11.3 Post-Termination

Outstanding seller payments will be held for 90 days to cover potential disputes, chargebacks, or refunds. After 90 days, remaining positive balances will be paid out to the seller's registered payment method. User data will be retained as required by UAE law, then securely deleted in accordance with our Privacy Policy. Terminated users may not create new accounts without hubl's written approval.

12. PLATFORM AVAILABILITY & TECHNICAL ISSUES

12.1 Service Availability

hubl aims for 99.5% uptime but does not guarantee uninterrupted service. We will do our utmost to ensure that availability of hubl will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed. Scheduled maintenance will be announced 24 hours in advance when possible. hubl is not liable for losses due to temporary service interruptions.

12.2 Technical Support

Technical support is available through hello@hubl.shop. Response times may vary based on issue complexity. Critical issues affecting payment processing or security receive priority.

12.3 Force Majeure

hubl is not liable for service disruptions due to circumstances beyond reasonable control, including but not limited to natural disasters, government actions or regulations, internet outages or infrastructure failures, cyberattacks or security breaches beyond hubl's control, or pandemics or public health emergencies. We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control.

13. DATA PROTECTION & PRIVACY

13.1 Data Collection

hubl collects only necessary data to facilitate marketplace transactions. User data is processed in accordance with UAE data protection regulations. Personal data is not sold to third parties. For full details, please review our Privacy Policy.

13.2 Data Security

hubl implements industry-standard security measures to protect user data. Users are notified of any data breaches as required by UAE law. Payment information is processed securely through Stripe and is not stored on hubl servers.

13.3 Data Rights

Users may request access to their personal data. Users may request data correction or deletion (subject to legal retention requirements). Data retention periods comply with UAE legal requirements. To exercise data rights, contact hello@hubl.shop.

14. COMMUNICATION GUIDELINES

14.1 Acceptable Communication

All platform communications must be respectful and professional. Communications must be relevant to transactions or platform use. Users should respond to messages in a timely manner.

14.2 Prohibited Communications

Harassment, discrimination, or abusive language; spam or unsolicited marketing messages; attempts to circumvent platform fees or take transactions offline; sharing personal contact information in public areas (product listings, reviews, etc.); or false or misleading information are strictly prohibited.

15. REVIEWS, COMMENTS & USER CONTENT

You may post reviews, comments, and other content; send communications; and submit suggestions, ideas, comments, questions, or other information, as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam". You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of content. We reserve the right (but not the obligation) to remove or edit such content.

If you post customer reviews, comments, customer questions or answers, or other content generated by you for display on the platform (including any images, video, or audio), you grant hubl a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, create derivative works from, distribute, make available, translate, and modify such content throughout the world in any media. You grant hubl and hubl's sublicensees the right to use the name that you submit in connection with such content.

You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; and that use of the content you supply does not breach any applicable policies or guidelines and will not cause injury to any person or entity. You agree to indemnify hubl for all claims brought by a third party against hubl arising out of or in connection with the content and material you supply. hubl has the right but not the obligation to monitor and edit or remove any activity or content. hubl takes no responsibility and assumes no liability for any content posted by you or any third party.

16. INTELLECTUAL PROPERTY RIGHTS

All content included in or made available through hubl, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations is the property of hubl or its content suppliers and is protected by local and international copyright, authors' rights, and database right laws. The compilation of all content included in or made available through hubl is the exclusive property of hubl and is protected by local and international copyright and database right laws.

hubl respects the intellectual property of others. If you believe that your intellectual property rights have been used in a way that gives rise to concerns of infringement, please contact hello@hubl.shop. Graphics, logos, page headers, button icons, scripts, and service names included in or made available through hubl are trademarks or trade dress of hubl. hubl's trademarks and trade dress may not be used in connection with any product or service that is not hubl's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits hubl.

17. LICENSE & ACCESS

Subject to your compliance with these Terms and Conditions and your payment of any applicable fees, hubl grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of hubl. This license does not include any resale or commercial use of hubl or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of hubl or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

All rights not expressly granted to you in these Terms and Conditions are reserved and retained by hubl or its licensors, suppliers, publishers, rights holders, or other content providers. No part of hubl, nor any part of its content may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent. You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of hubl without our express written consent. You may not use any meta tags or any other "hidden text" utilizing hubl's names or trademarks without our express written consent.

You may not misuse hubl. You may use hubl only as permitted by law. The licenses granted by hubl terminate if you do not comply with these Terms and Conditions.

18. AUTOMATED ACCESS & BOTS

No automated software, service, or bot ("Agent") may access, use, or interact with hubl unless, at all times, it identifies itself and operates in accordance with the following requirements. In addition, no Agent may access, use, or interact with hubl if we have requested that the Agent refrain from doing so. At our sole discretion, we may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with hubl.

Agents must: (a) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including "Agent/[agent name]" in the request's user agent string; (b) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by mimicking the speed or pattern of human keystrokes, page navigation, or other interactions, or by completing or circumventing CAPTCHAs or other measures intended to distinguish computers from humans; (c) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer; and (d) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with hubl.

19. SANCTIONS & EXPORT COMPLIANCE

You may not use hubl if you are the subject of U.S. sanctions or of sanctions consistent with U.S. law imposed by the governments of the country where you are using hubl. You must comply with all U.S. or other export and re-export restrictions that may apply to goods, software, technology, and services. Nothing in these Terms and Conditions shall, or shall be interpreted or construed to, induce or require hubl or you to act in any manner (including taking or failing to take any actions in connection with a transaction) which is inconsistent with or penalized under any applicable U.S. laws, regulations, rules, or requirements.

20. LIMITATION OF LIABILITY

20.1 Liability Caps

hubl's total liability to any user is limited to the fees paid by that user to hubl in the 12 months preceding the claim. hubl will not be responsible for (i) losses that were not caused by any breach on our part, or (ii) any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill, or wasted expenditure), or (iii) any indirect or consequential losses that were not foreseeable to both you and us when you commenced using hubl. This limitation applies to all claims, whether based on contract, tort, warranty, or other legal theories.

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your legal right to have goods sent or services provided within a reasonable time or to receive a refund if goods or services ordered cannot be supplied within a reasonable time owing to a cause beyond our reasonable control.

20.2 User Indemnification

Users agree to indemnify, defend, and hold harmless hubl, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: user's use of the platform; user's violation of these Terms and Conditions; user's violation of any law or third-party rights; seller's products, services, or business practices; or product liability claims related to seller's products.

20.3 Exclusions

These limitations do not apply to damages caused by hubl's gross negligence or willful misconduct. Limitations may not apply where prohibited by UAE law.

21. GOVERNING LAW & DISPUTE RESOLUTION

21.1 Applicable Law

These Terms and Conditions are governed by UAE federal law and Dubai local regulations. These conditions are governed by and construed in accordance with the laws of the Dubai International Finance Center ("DIFC"). If any dispute, claim, difference, or controversy arising out of, relating to, or having any connection with these conditions, including as it may relate in any way to your use of hubl, or to any products or services sold or distributed by hubl or through hubl.shop, or the existence, validity, interpretation, performance, breach or termination and/or any dispute relating to any non-contractual obligations arising out of or in connection with them (for the purpose of this section, a "Dispute") qualifies for determination through the DIFC Small Claims Tribunal ("SCT"), then the SCT shall have exclusive jurisdiction to settle any such Dispute. For Disputes that do not qualify for determination through the SCT, the courts of the DIFC shall have exclusive jurisdiction to settle such Dispute and each party submits to the exclusive jurisdiction of the courts of the DIFC. For the purposes of this section, you waive any objection to either the courts of the DIFC or the SCT, as applicable, on the grounds that either of them is an inconvenient or inappropriate forum to settle any Dispute.

21.2 Dispute Resolution Process

Step 1: Direct Negotiation - Parties agree to attempt to resolve disputes through good-faith negotiation. Step 2: Mediation - If negotiation fails, parties may agree to mediation through the Dubai International Arbitration Centre (DIAC). Step 3: Legal Action - As a final resort, disputes will be resolved through Dubai courts or DIFC as outlined above.

21.3 Class Action Waiver

Users agree to resolve disputes individually and waive the right to participate in class action lawsuits against hubl.

22. MODIFICATIONS TO TERMS

hubl reserves the right to modify these Terms and Conditions at any time. We reserve the right to make changes to hubl, policies, terms and conditions including these Terms and Conditions at any time. Users will be notified of material changes via email or platform notification 14 days in advance. You will be subject to the terms and conditions, policies, and Terms and Conditions in force at the time that you use hubl. Continued use of the platform after changes take effect constitutes acceptance of the modified terms. If users do not agree to modified terms, they must discontinue use of the platform. If any of these Terms and Conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

23. WAIVER

If you breach these Terms and Conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms and Conditions.

24. SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

25. ENTIRE AGREEMENT

These Terms and Conditions, along with the Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between users and hubl.

Shipping Information Requirements

Sellers must provide accurate shipping costs and delivery timeframes in product listings. Sellers should offer tracking information when available. Sellers must update buyers on shipping status through hubl's messaging system. Sellers must ship orders promptly and within the timeframe communicated to buyers.

Local Delivery Benefits

Sellers are encouraged to highlight local delivery advantages (faster delivery, lower costs, supporting local businesses). Sellers may offer multiple shipping options (standard, express, local pickup, same-day delivery, etc.). Clearly communicate any restrictions or special requirements for each shipping method.

Shipping Delays

Sellers must communicate any shipping delays to buyers immediately. Repeated shipping delays or failures may result in account review, warnings, or suspension.

FOR BUYERS

Shipping Expectations

Shipping is arranged and fulfilled by individual sellers, not hubl. Shipping costs and delivery times vary by seller, product, and location. Buyers should review shipping information carefully before completing purchase. Tracking information (if available) will be provided by the seller.

Delivery Issues

Contact the seller directly through hubl's chat feature for shipping inquiries, delays, or issues. Allow sellers 48-72 hours to respond. For unresolved shipping disputes after 7 days, contact hello@hubl.shop.

Address Accuracy

Buyers are responsible for providing accurate and complete shipping addresses. Address changes after purchase must be coordinated directly with the seller. hubl and sellers are not responsible for delivery failures due to incorrect buyer-provided addresses.

PLATFORM RESPONSIBILITY

hubl is not responsible for shipping delays, lost packages, or delivery issues. All shipping-related disputes should be resolved between buyer and seller. hubl will facilitate communication but cannot force seller compliance with shipping commitments.

FOR SELLERS

Refund Responsibility

Sellers are fully responsible for handling all returns, refunds, and exchanges. Sellers must clearly state their return/refund policy in their shop settings and product listings. Sellers should respond to refund requests promptly (within 48-72 hours). Sellers must process approved refunds within 7 business days.

Recommended Practices

Sellers should clearly communicate: return window (e.g., 7, 14, or 30 days from delivery); condition requirements for returns (unused, original packaging, tags attached, etc.); who pays return shipping costs (buyer or seller); refund processing timeframes; non-returnable items (if any); and restocking fees (if applicable).

Refund Processing

Refunds should be issued to the original payment method when possible. Sellers must provide proof of refund to buyers upon request. Repeated failure to honor refund commitments may result in account suspension or termination.

FOR BUYERS

Return Process

Step 1: Review the seller's specific return policy before purchasing. Step 2: Contact the seller directly through hubl's chat feature to initiate a return. Step 3: Follow the seller's return instructions and requirements. Step 4: Provide proof of return shipment (tracking number) if required. Step 5: Allow 7 business days for refund processing after seller receives the return.

Refund Expectations

Refund timelines and conditions are set by individual sellers. hubl does not process refunds directly. Payment disputes should first be addressed with the seller. Refunds are typically issued to the original payment method.

Escalation Process

If unable to resolve return/refund issues with the seller: Step 1: Contact hello@hubl.shop with order details, communication history, and supporting documentation. Step 2: hubl will review the case individually and facilitate communication. Step 3: hubl cannot guarantee resolution or force seller compliance. Step 4: Buyers may consider payment processor dispute options (chargebacks) for unresolved issues.

DISPUTE RESOLUTION

Step 1: Contact seller directly through hubl messaging. Step 2: If unresolved within 7 days, email hello@hubl.shop with order number, description of issue, screenshots of communication with seller, and any supporting documentation (photos, receipts, etc.). Step 3: hubl will facilitate communication but cannot force seller compliance. Step 4: Buyers may pursue chargeback through their bank for unresolved issues involving non-delivery, significantly misrepresented products, or seller fraud.

PLATFORM RESPONSIBILITY

hubl is not liable for seller refund policies or non-compliance. hubl will take action against sellers who consistently fail to honor reasonable refund requests. Sellers with repeated refund-related complaints may face account suspension or termination.
